Privacy Policy

This policy explains how Foundesk ("Foundesk," "we," "us") collects, uses, and protects information through foundesk.io and the AI coworkers and business systems we implement and support for clients.

Mobile information is never sold or shared for marketing. No mobile information, phone number, or SMS consent will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information may be shared only with the service providers that operate the messaging system on our behalf, and only to deliver the service. Text messaging originator opt-in data and consent are not shared with any third party except subcontractors and providers required to deliver the messaging service.

Calls, messages, and automated tools

Where you call, email, text, or chat with Foundesk, we may collect and retain the content of that communication, associated contact details, and timestamps. Where a client system we configured includes an automated or AI assistant, that assistant may generate transcripts or summaries and may be used to route, respond to, or schedule from an enquiry. Those systems run on platforms the client subscribes to, under that client's own account.

Meetings and calls

When you book a call, we collect your name, email, and the answers you give on the booking form. Video calls are not recorded unless we tell you at the start and you agree. Where a call is recorded for note-taking, the recording and any notes are used only to deliver the work discussed.

2. Call recording and consent

Foundesk does not routinely record calls. Where a call is recorded, we say so at the start and you may decline. Recording laws vary by state, and where all parties must consent, we obtain that consent before recording.

Where Foundesk configures call recording, transcription, or automated messaging inside a client's own platform, the client is responsible for determining and meeting the consent requirements that apply to their customers and jurisdictions. We configure the tools; we do not provide legal advice about recording or messaging law.

3. How we use information

We do not sell personal information, and we do not engage in targeted advertising based on personal data as those terms are defined under Texas law.

4. Service providers

We rely on third-party platforms to operate. These providers process information on our behalf under their own terms and privacy policies. They include, and may change over time:

We may also disclose information where required by law, to enforce our agreements, to protect rights and safety, or in connection with a merger, acquisition, or sale of assets.

5. Client data and our role

When Foundesk builds or supports a system for a client, that client's customer records, conversations, bookings, and payment records belong to the client. Software subscriptions are held in the client's own name and accounts. Foundesk handles information on the client's behalf only to deliver and support the work.

Where a client gives us administrative access to their platforms, that access is used only for building, configuring, supporting, and troubleshooting their systems. It is never used to contact a client's customers for our own marketing. Access can be revoked by the client at any time.

If you are a customer of a Foundesk client and wish to exercise rights over your information, contact that business directly. We will support our client in responding.

6. Cookies and analytics

The site uses essential cookies and browser storage necessary for the site to function and to remember preferences. Where optional analytics or marketing cookies are used, they are enabled only after consent and may be declined. You can also control cookies through your browser settings; disabling essential cookies may affect site functionality.

7. Retention

We keep information for as long as needed to provide the service and for a reasonable period afterward to meet legal, tax, and record-keeping obligations. As general guidance: enquiry records are kept up to 24 months after last contact; client project records are kept for the engagement plus 7 years; any call recordings or notes are kept up to 12 months; financial records are kept as required by law. You may request earlier deletion, subject to those obligations.

8. Your rights

Depending on where you live, including under the Texas Data Privacy and Security Act, you may have the right to:

To exercise a right, email privacy@foundesk.io. We will verify your identity before acting and will respond within the timeframe required by applicable law. If we decline a request, you may appeal by replying to our response; if an appeal is denied, you may contact the Texas Attorney General.

9. Marketing and messaging choices

You may unsubscribe from marketing email using the link in any message. If you have opted in to text messages, reply STOP to stop them; see our SMS Terms. We may still send service messages relating to an active engagement.

10. Referral relationships

Where we recommend a software product we use ourselves, we may participate in that vendor's referral or affiliate program and receive a commission if you subscribe. This is at no additional cost to you, does not affect the price you pay the vendor, and does not change what we recommend. We will tell you when a recommendation carries a referral relationship. You always purchase and hold the subscription in your own name.

11. Security

We use administrative and technical safeguards appropriate to our size, including access controls, provider-managed encryption in transit, limited administrative accounts, and multi-factor authentication where available. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify affected individuals and regulators as required by applicable law.

12. Children

Our website and services are intended for adults operating or starting a business. We do not knowingly collect personal information from anyone under 16. If we learn that we have, we will delete it.

13. International visitors

Foundesk operates in the United States, and information is processed there. If you access the site from outside the United States, you understand that your information will be transferred to and processed in the United States.

14. Changes

We may update this policy as our services evolve. The effective date above reflects the current version. Material changes will be noted on this page.
