These terms govern your use of foundesk.io and the information published on it. By using the site you agree to them. Services purchased from Foundesk are governed by a separate written service agreement, which controls if there is any conflict with these terms.
No results guarantee. Foundesk implements AI coworkers and configures the business systems they work across. It does not guarantee revenue, customers, bookings, search rankings, or any particular business outcome. Any figures, dashboards, screenshots, or examples shown on this site are illustrative only and do not represent typical or expected results. Business results depend on factors outside our control, including your market, offer, pricing, effort, and execution.
1. Informational purpose
Site content is general information about Foundesk and its services. It is not legal, tax, accounting, financial, or professional advice. Decisions about business formation, licensing, insurance, tax treatment, employment, and regulatory compliance are yours, and you should consult qualified professionals.
2. Services and scope
Deliverables, timelines, pricing, revisions, responsibilities, third-party costs, ownership, support, and cancellation are defined in the written service agreement for the applicable engagement. Prices shown on this site are starting points, quoted properly after a scoping call. Nothing on this site constitutes an offer capable of acceptance or a binding commitment to provide services on stated terms.
3. Third-party platforms
Foundesk configures third-party platforms, including AI coworker platforms, CRM, email, scheduling, payment, automation, and AI providers. Their availability, features, pricing, policies, and performance are controlled by those providers and may change or be discontinued. Foundesk is not responsible for a third-party provider's outage, price change, policy change, account suspension, or discontinuation of a feature.
Software subscriptions are purchased and held by the client in the client's own accounts. Foundesk does not resell software. Where a client grants Foundesk administrative access for configuration and support, that access may be revoked by the client at any time.
3a. Referral relationships
Where Foundesk recommends a product it uses itself, it may participate in that vendor's referral or affiliate program and receive a commission if the client subscribes. This is at no additional cost to the client and does not change what is recommended. Foundesk discloses referral relationships when a recommendation is made.
4. Client responsibilities
If you engage Foundesk, you are responsible for:
- The accuracy and lawfulness of the content, offers, claims, pricing, and credentials you provide
- Holding any licenses, registrations, permits, or insurance your business requires
- Obtaining valid consent before your customers are contacted by phone, text, or email through systems we configure, and complying with laws governing those communications, including the Telephone Consumer Protection Act and applicable state law
- Determining and meeting call recording consent requirements applicable to your customers
- Your own software subscriptions, usage charges, and accounts with third-party providers
- Reviewing automated and AI-generated content before it is relied upon or published
5. Automated and AI features
Where we configure AI coworkers, chatbots, or automated replies, those systems generate text, summaries, and responses automatically. Automated systems can be inaccurate, incomplete, or unavailable, and may misunderstand a request. They are a support tool and not a substitute for human judgment or professional advice. Foundesk does not warrant that automated output will be accurate, uninterrupted, or suitable for a particular purpose, and you remain responsible for communications sent from your business.
6. Intellectual property
Foundesk branding, site copy, design, templates, frameworks, and methods are owned by Foundesk and may not be copied, resold, or redistributed without written permission. Work delivered for a client, and the client's own data, belong to the client as set out in the applicable service agreement. Third-party trademarks and logos shown on this site are the property of their owners and appear only to identify platforms we work with; their appearance does not imply endorsement, sponsorship, or partnership.
7. Acceptable use
You may not misuse the site, interfere with its operation, attempt unauthorized access, scrape or harvest data, introduce malicious code, or use site content unlawfully or in a way that infringes the rights of others.
8. Disclaimer of warranties
The site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Foundesk and its owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, or business interruption, arising from or relating to your use of this site, even if advised of the possibility. Foundesk's total aggregate liability arising from or relating to your use of this site will not exceed one hundred United States dollars ($100). Liability arising from a paid engagement is governed by the applicable service agreement. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify and hold harmless Foundesk from claims, damages, liabilities, and reasonable legal costs arising from your misuse of the site, your violation of these terms, your violation of law, or your infringement of another party's rights.
11. Third-party links
The site may link to third-party websites and resources. We do not control and are not responsible for their content, policies, or practices.
12. Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. The exclusive venue for any dispute arising from these terms is a state or federal court located in Texas, and you consent to that jurisdiction.
13. Informal resolution
Before filing a claim, you agree to contact us and attempt to resolve the matter informally for at least thirty (30) days after written notice.
14. Changes
Foundesk may update these terms as its services evolve. Continued use of the site after an update constitutes acceptance of the revised terms.
15. Severability and entire agreement
If a provision is found unenforceable, the remaining provisions stay in effect. These terms, together with the Privacy Policy and SMS Terms, are the entire agreement regarding your use of this site.
